The Ministry of Commerce (MOC) made its initial announcement to all natural persons and legal entities operating E-commerce businesses that they neaed to apply for an E-commerce Permit or License on 26 May 2021.
Notwithstanding four extensions granted by the MOC for doing so, without penalty for late submission (the due date of the penalty exemption is on 3 July 2022), the MOC has announced that it will continue to receive applications for an E-commerce Permit or License in accordance with the following:
- A Legal entity, foreign branch, or sole proprietor who has been conducting E-commerce business without permission from the MOC must file an application and will be penalized in accordance with the relevant law;
- A Legal entity, foreign branch, or sole proprietor who has just commenced or intends to conduct E-commerce business may apply for an E-commerce Permit or License without any penalty;
- A natural person having a turnover below the turnover threshold of small taxpayers (being KHR250,000,000 to 1,000,000,000 (equivalent to US$62,500 to 250,000) can apply to the MOC for an exemption to the requirement to obtain an E-commerce Permit or License, or if the natural persons still wish get the permission, they can apply for the E-commerce Permit or License without any penalty.
